The Reform to Art. Article 22 of the Political Constitution of the United Mexican States in 2019 reinvented the figure of the extinction of dominion in Mexico in terms of the legal nature, origin, exercise, competent authorities, rights and guarantees of the subject in the procedure and the control and administration of the assets; In a first analysis, the sense and scope of the Reform originates diverse reflections that must be analyzed according to the National Law of Extinction of Dominion (LNED) -which repealed the federal law and the local laws in the matter-, due to the fact that certain inconsistencies are identified that disorient the sense of such figure and that seem dissociated with the Mexican Positive Law, The reform and the LNED were not resolved by the reform and the LNED, so it is necessary to analyze the background of the reform and the new law in order to propose the respective solution, either through jurisprudence or the reform process in the long term, which will motivate the improvement of this institution in legal practice.
