The judicialization of politics is a process that occurs in countries that adopt the constitutional democratic system as a form of political organization, in which the institutions of the Judiciary go beyond their conventional powers, interfering or reassessing the political decisions of the Legislative and Executive Powers through what is conventionally called judicial review and/or constitutionality control, that is, the Law intervenes in politics in some cases, a process considered by many as strengthening democracy. This discussion, which has emerged in the international arena, has been widely debated and the target of research that seeks to consolidate theories and measure the effects of this phenomenon on contemporary democratic societies, entering the regional context.
