General Terms and Conditions MoreBooks!

What is MoreBooks!?

MoreBooks! is the online shop of the publisher OmniScriptum and a brand of VLC Publishing OÜ.

What do these conditions apply to?

These General Terms and Conditions apply to your purchases in the portal www.morebooks.shop. These General Terms and Conditions apply to resellers only to the extent that separate contractual agreements that deviate from these Terms and Conditions have not been agreed with them.

Which law applies?

Estonian law shall apply in the case of consumers ordinarily domiciled or resident in a member state of the European Union (EU) or the European Economic Area (EEA) at the time of conclusion of the contract; the UN Convention on Contracts for the International Sale of Goods is excluded.

In all other cases, this contract shall be governed by Estonian law; the UN Convention on Contracts for the International Sale of Goods and Estonian consumer protection law are excluded. To the extent permissible, Tallinn is agreed as the court of jurisdiction for disputes arising from this contract. This shall also expressly apply in the event that you are a resident outside Estonia or have used our website in a language other than English. Insofar as difficulties of interpretation may arise due to language differences/translations in the case of multi-lingual versions of the present General Terms and Conditions, the English text shall have precedence.

With whom am I concluding this agreement?

Your contractual partner is VLC Publishing OÜ https://www.morebooks.shop/site/gb/imprint/1 of Tallinn, Estonia.
You can reach us by email: customerservice@morebooks.shop. The easiest way to contact us is to send a message using the contact form https://www.morebooks.shop/contact/gb/new

How do I make an order?

You are free to browse our offers. When you find something interesting, place the product in your virtual shopping cart. To do this, click the button "Add to cart" that we have inserted to the right of the product. You can, of course, remove products from your shopping cart or change the quantity at any time. To do this, move your cursor over the button "x products in the shopping cart" in the top section of the screen. Then click "Update cart" to display the current order value and the ordered products or "Edit cart" to add further titles, delete titles or change the quantity. To continue the order process, click the "Checkout" button. You will be asked to enter the user data that you use to log in or to register as a new user.

After you log in or register, you first need to select the billing address and, if required, a separate shipping address, and then at the next stage, your chosen shipping method and payment method. After this, an overview is displayed which shows all the products placed in your shopping cart and all the costs related to your order. During the order process, you always have the opportunity to go back to the previous stage or to abort the order process. To complete the order, send your order by clicking the button "Confirm order (liable to pay)".

I made an input error. How can I correct it?

Before you submit your binding order, a page is displayed that shows all your entries as they will to appear to us. You have the opportunity to bring up an entry form to correct your entries, if this is necessary. After you have sent an order, you will receive an email in which we acknowledge receipt and which contains all the information that we have received. You can review order transactions retrospectively at any time.

Until payment, you can cancel the order without giving reasons. After payment, returns are only possible in the event of defects or under an existing right to cancel (see below "What cancellation rights do I have?"); online cancellation is no longer possible.

What is the legal significance of my order?

Your order constitutes an offer to enter into a contract with us. By clicking the button "Confirm order (liable to pay)", you make a binding declaration that you want to purchase the ordered goods. On the basis of your entries, we then check whether we can process your order. Our email to you after you submit your order only acknowledges receipt of your order as an offer and advises you that we are processing your transaction. This "Order Confirmation" does not constitute acceptance of the contract. The contract for the purchase of a product only comes into effect when we confirm acceptance of your order and with it the conclusion of a contract in a further email labelled "Confirmation of Contract". You will receive this message immediately after we receive your payment. We store your order, your order confirmation and the confirmation of contract / acceptance of contract. On request, we can send these to you together with our General Terms and Conditions.

Why do you reserve the right to refuse my order?

We always want to fulfil your order to your satisfaction. In rare cases, a publisher informs us, for example, that the book that we have listed and that you have ordered is no longer currently available. In such event we would reject your order; a contract would not come into effect. If, during the processing of the order we discover other errors, such as a typographical error on our website, we would also reject your offer and propose an alternative suggestion to you. In exceptional cases, we reserve the right to reject orders without giving reasons. You will be notified of the rejection by email to the address that you have specified.

How do I find out about the delivery?

As soon as the goods that you have ordered are shippable and have been dispatched, you will receive a further email from us.

How will the books reach me?

When you place your order, you select the shipping method ("Standard" / "Premium") yourself. At this point, the shipping costs incurred depending on the size / weight of the order and the shipping address that you have specified will be displayed to you. Depending on your selection, it falls on us to select the specific courier (e.g. the Deutsche Post, DHL, FedEx, UPS, DHL Express or comparable service providers). The delivery will be made by the courier to the address that you have specified.

How do I pay for my order?

When entering an order on our website, the possible payment methods for the respective order are stated. You can choose the payment method that appears to be the most convenient for you. In the case of bank transfers, the customer always bears the cost of the transfer. You must ensure that bank transfers are made with the instruction "OUR" (sender pays costs). The goods supplied remain our property until payment has been received in full.

Are there any additional costs, for example, for communicating with you?

The ordering process is free of charge for you. Upon payment, costs as agreed with your bank or credit card company may be incurred. However, these are not part of your legal relationship with MoreBooks!. Apart from the total price stated above, we do not apply any additional charges for the financial transaction.

Communicating with us by email is, of course, free of charge.

What warranty claims apply?

Warranty claims apply within the framework of statutory liability for defects.

What cancellation rights do I have?

Consumers ordinarily domiciled or resident in a member state of the European Union (EU) or the European Economic Area (EEA) at the time of conclusion of the contract have a statutory right to cancel. A consumer means every natural person who enters into a legal transaction for a purpose that is outside his trade, business or self-employed profession. Expressly excluded within the meaning of this act are resellers, legal and natural persons who, by virtue of other contractual relationships with VLC Publishing OÜ, are able to make use of special conditions for the purchase of discounted goods on MoreBooks!.

As a consumer, you can withdraw your declaration of intention to enter into a contract (your order) within 14 days in the written form stipulated by law. The period begins from receipt of these instructions in written form although not before the goods have been received by the recipient. To meet the deadline for cancellation, it is sufficient for you to send us a message advising us that you want to exercise your right to cancel before the expiry of the cancellation period. No cancellation right shall apply to articles that have been specially manufactured for you. In the case of audio or video recordings, for example on CD or DVD, or the supply of software, it expires on removal of the seal. Furthermore, no cancellation right applies in the case of goods that were not prefabricated and for whose manufacture an individual selection or stipulation made by the consumer is material or which were clearly tailored to the personal needs of the consumer.

To whom do I send my cancellation request?

To exercise your cancellation right, you must send a clear statement, for example, a letter by post to:

VLC Publishing OÜ

Pikaliiva 90/2-32, Tallinn, 13516 Estonia, European Union

or an email to customerservice@morebooks.shop
with which you inform us of your decision to cancel your order. You can use the template cancellation form that is enclosed with your order and can be downloaded from our website https://www.morebooks.shop/site/gb/impressum/1

What are the consequences of cancellation?

If you cancel your order, you must return or hand over the goods to us without delay and in any event no later than within 14 days from the day on which you informed us of the cancellation of the order. The deadline is met if you send the goods before the expiry of the 14-day period. You must bear the direct costs of returning the goods. You must bear the costs for any loss in value in the goods in the event that this loss in value is due to them being handled for anything other than the purposes of inspecting their properties and functioning.

In the event of effective cancellation and return of the goods in accordance with these provisions, we shall refund to you all payments that we have received from you, including the original standard shipping costs. Additional costs that arose because you chose a different type of shipping that the cheapest standard shipping method offered by us shall not be refunded.

The refund will be made without delay and at the latest within 14 days from the day on which we received your notice of cancellation of the order and we have received the goods or you have provided proof that you have returned the goods. For this refund, we generally use the same payment method that you used in the original transaction or, to the extent possible, a payment method that incurs lower charges than the one originally chosen by you. In no event shall compensation be paid to you because of this refund on our part.
